The company is withdrawing the previous petition filed in the Bombay High Court in this matter.

The Flipkart group company said in a statement on Friday night that PhonePe had approached the Bombay High Court seeking a stay on Resilient Innovations, which operates BharatPe, to stop abusing the registered trademark of PhonePe as “Postpay” or “Postpay”. “Postpay” marks were used and promoted.

During the hearing, the court observed that the PostPay mark adopted by Resilient Innovations is phonetically, structurally and visually identical to the PhonePe symbol that it also thought that ‘Postpay/Postpay’ is a natural evolution of the word PhonePe and is derived from PhonePe. PhonePe said in the statement, “However, to address certain observations made by the Court in the petitions filed by PhonePe, Resilient Innovations is at liberty to file a fresh suit challenging the adoption of Mark PostPay/PostPay.” withdrawn.” That while allowing the withdrawal of the suit and keeping the rights and arguments of the parties open, the court granted liberty to PhonePe to file a fresh suit.

“Accordingly, we will file a fresh lawsuit and continue to oppose the use of the ‘PostPe’ symbol at ‘PostPe’https://economictimes.indiatimes.com/”postpe’,” PhonePe said in a statement.

When contacted by PTI, a BharatPe spokesperson said the company does not wish to comment on any part of Friday’s proceedings in the Bombay High Court which is not recorded in the order passed.

“In order to maintain the dignity of the legal process, we will await the receipt of the order passed by the Hon’ble Bombay High Court tomorrow,” the spokesperson said.

“The main point is that PhonePe has withdrawn the suit filed against our use of PostPay. Needless to say, we will continue to strongly defend any legal action that PhonePe threatens to institute against us.”
